Terms of Service

Last Updated: March 31, 2026

Please read these Terms of Service carefully before using the SwimOS platform. By accessing or using our services, you agree to be bound by these terms.

1. Introduction

SwimOS is a Software-as-a-Service (SaaS) platform designed exclusively for swim schools. It provides tools for lead management, trial booking, student enrolment, team scheduling, and business analytics — all in one place.

By accessing or using the SwimOS platform ("Platform"), you ("User") agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. Your continued use of the Platform constitutes acceptance of any updates to these Terms.

2. Definitions

  • "Platform"— The SwimOS web application, including all features, tools, and services provided at swimos.app.
  • "User"— Any individual who accesses or uses the Platform, including swim school owners, staff, and administrators.
  • "Swim School"— A business entity that operates swimming instruction services and uses the Platform to manage its operations.
  • "Lead"— A prospective student or parent who has expressed interest in swimming lessons and whose information is captured within the Platform.
  • "Service"— All features, functions, and capabilities provided by SwimOS through the Platform, including CRM, booking, scheduling, and analytics.

3. Eligibility

By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

The Platform is intended for business use by swim schools and their authorised staff. It is not intended for personal or consumer use. You must be acting on behalf of a legitimate swim school or aquatic education business to register and use the Platform.

4. Account Registration

To access the Platform, you must register for an account and provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Swim school owner accounts may require admin approval before full access is granted. SwimOS reserves the right to approve, decline, or revoke any account at its discretion.

You agree to promptly notify SwimOS of any unauthorised use of your account or any other security breach. SwimOS will not be liable for any losses arising from unauthorised access due to your failure to safeguard your credentials.

5. Use of the Platform

Permitted Use

You may use the Platform solely for lawful business purposes, including:

  • Managing leads and enquiries from prospective students
  • Scheduling and booking trial lessons
  • Managing student enrolments and class schedules
  • Communicating with staff and instructors
  • Tracking business analytics and campaign performance

Prohibited Use

You must not:

  • Use the Platform for any illegal or unauthorised purpose
  • Misuse, sell, or transfer lead data obtained through the Platform to third parties
  • Send unsolicited bulk messages (spam) via any Platform communication feature
  • Attempt to reverse-engineer, copy, or replicate the Platform's software
  • Interfere with or disrupt the integrity or performance of the Platform
  • Use the Platform in a way that violates applicable data protection laws

6. Subscription & Payments

SwimOS offers tiered subscription plans including a Free tier and paid tiers (Growth and Pro). Paid subscriptions are billed on a monthly recurring basis via our payment processor, Stripe.

By subscribing to a paid plan, you authorise SwimOS to charge your nominated payment method at the start of each billing cycle. All prices are listed in USD unless otherwise stated.

You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

SwimOS reserves the right to modify pricing with reasonable notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

7. Data & Privacy

You retain full ownership of all data you enter into the Platform, including lead information, student records, and business data. SwimOS does not claim any ownership over your data.

SwimOS processes your data solely for the purpose of delivering the Service, improving platform functionality, and providing support. We do not sell your data to third parties.

Our full Privacy Policy (available at swimos.app/privacy) outlines how we collect, store, and handle data in detail. By using the Platform, you also agree to our Privacy Policy.

8. Lead Management Responsibility

SwimOS provides tools to capture, organise, and track leads. However, SwimOS does not guarantee the quality, accuracy, or conversion of any leads generated through or managed within the Platform.

You and your team are solely responsible for following up with leads, managing communications with prospective students, and ensuring compliance with applicable marketing and communication laws when contacting leads.

9. Integrations

The Platform may integrate with third-party services, including but not limited to Facebook Ads, Google Calendar, WhatsApp, and Stripe. These integrations are provided for your convenience.

SwimOS is not responsible for any outages, data loss, or service disruptions caused by third-party platforms. Your use of integrated services is also subject to those providers' own terms and conditions.

10. Service Availability

SwimOS will make reasonable efforts to ensure the Platform is available and operational at all times. However, we do not guarantee uninterrupted or error-free service.

The Platform may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.

11. Limitation of Liability

To the fullest extent permitted by law, SwimOS and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of revenue or business profits
  • Missed leads or failed conversions
  • Loss of data or data corruption
  • Costs of substitute services

SwimOS's total aggregate liability to you for any claims arising out of or related to these Terms or the Platform shall not exceed the total fees paid by you to SwimOS in the three (3) months preceding the claim.

12. Termination

SwimOS reserves the right to suspend or permanently terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent activity, or act in a manner that is harmful to the Platform or other users.

Upon termination, your access to the Platform will cease immediately. You may request an export of your data prior to termination. SwimOS is not obligated to retain your data following account termination.

13. Changes to Terms

SwimOS may update these Terms from time to time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by email notification.

Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
